Summary proceedings were instituted on September 20, 1934, to recover possession of a store and basement located in the building known as 503 Fifth avenue, on the northeast corner of Forty-second street and Fifth avenue, New York city, for the failure of the tenants to pay rent under a written lease for the month of September, 1934. Judgment for $3,000 *140rent due for September is also demanded. On September twenty-fifth the tenants filed a joint answer in which they set up fifteen alleged defenses and a counterclaim for $22,000.
