This is a motion for summary judgment. The action was instituted by the plaintiffs to recover the sum of $13,750, the installment of rent due on July 1, 1934, pursuant to the terms of a written lease made on or about June 24, 1922, between the defendant and one Leo Schlesinger, plaintiffs’ predecessor in title. The premises affected by the lease are known as 637-643 Madison avenue, New York city, and are situated on the northeast corner of Madison avenue and Fifty-ninth street, borough of Manhattan, city of New York.
