THE COURT.

Appeal from a judgment entered on a jury’s verdict for the plaintiff in an action to recover damages for personal injuries.

On August 28, 1933, the plaintiff was employed by Grünewald & Tudor, who were under contract to do excavating work at 114th Street and Budlong Avenue in the city of Los Angeles. The defendant, B. W. Belyea, who conducted a trucking business, was engaged by Grünewald & Tudor to haul an excavating shovel to that intersection on that day.
