Appeal from a judgment of the superior court for Snohomish county, Black, J., entered February 28, 1912, in favor of the plaintiffs, upon an agreed statement of facts, in an action of ejectment.

This action was commenced by Rasmus Konnerup and Anna Konnerup, his wife, against Frank C. Milspaugh, Millie Milspaugh, his wife, Bert Ernst and Cora Ernst, his wife, to recover possession of real estate.' From a judgment in plaintiffs’ favor, the defendants Milspaugh and wife have appealed.

The action was tried upon an agreed statement of facts as shown by a written stipulation filed herein, material portions of which read as follows:
