WEISBERGER, Chief Justice.

This case comes before us on the appeal of the plaintiff, Vargas Manufacturing Co. (Var gas), from a judgment entered in the Superi- or Court relieving the defendants, Jay Friedman (Friedman) and Gold Coast International Jewelry (GCI), of paying the balance due on a contract for the purchase of jewelry and awarding the defendants on their counterclaim a total of $40,000 in punitive damages.
