The following agreed statement of facts shows the manner in which the questions made by the appeal' arose: “On September 3d, 1907, the plaintiff, John T. Bramlett, through his attorney, Wilton H. Earle, served notice on the City Council of Greenville that he desired an arbitration, under the provisions of the charter then in eff ect, of a claim against the city amounting to three hundred dollars, for alleged damages to his property by the changing of grade of Hampton avenue in the year 1906.
