This action, instituted in the Court of Common Pleas for Charleston County, grew out of the death of Blaine L-Mowers, occurring in a collision between an automobile operated by the deceased, and a railway train of the defendant railway company at a grade crossing. The result of the trial before his Honor, Circuit Judge Mann, was a verdict of the jury and the judgment of the Court in favor of the defendant. The appeal here is on the part of the appellant from the adverse judgment and the refusal of the Court to grant a new trial.
