The Complaint in this action seeks rescission of a commercial shopping center lease and guaranty and related damages based on fraud in the inducement. Plaintiffs S-Fer International, Inc. (“S-Fer”) and its guarantor Moda Imports, Inc. (“Moda”) filed this action on January 13, 1995 in New York State Supreme Court, New York County, and defendant Paladión Partners, Ltd.
