Petitioner, Utility Workers Union of America, Local 246, AFL-CIO, challenges a National Labor Relations Board dismissal of a complaint alleging that Southern California Edison Co. violated § 8(a)(5) of the National Labor Relations Act (NLRA) by unilaterally implementing drug testing procedures for “red badge” employees working in the “Protected Area” of its San Onofre Nuclear Generating Station. In dismissing the charges, the Board deferred to an arbitrator’s determination that the parties’ collective bargaining…
