Petitioner was charged with obtaining a sum less than fifty dollars by false pretenses. The complaint upon which a warrant was issued from one of the police courts of the city of Oakland charges the commission of the alleged crime as of a time more than one year before the verification and filing of the said pleading, and the complaining witness swore to the circumstances of the offense “upon his information and belief.” Petitioner contends: 1.
