WHITAKER, Judge.

This is an action for breach of contract. Both parties have moved for summary judgment.

On July 18,1960, plaintiff was awarded a Department of the Navy contract to print and deliver a weekly newspaper called the Shipworker at New York Naval Shipyard. The contract was to run from August 1,1960 to June 30, 1961. The estimated total contract price was $40,000. *723After plaintiff had printed the editions of the Shipworker from August 5, 1960 to October 21,1960, he was orally advised that no further issues would be ordered from him.
