FITZPATRICK, District Judge:

Presently before this court is defendant’s motion for summary judgment. The material facts in this case are straightforward and undisputed. The case is a products liability suit brought by plaintiff, Tina Grimsley Walker, and her daughter, Luchelle Walker, against a pharmaceutical manufacturer, Merck & Co., Inc. (hereinafter Merck). Plaintiff Tina Grimsley Walker alleges injury to her daughter arising out of the mother’s receipt of a measles, mumps and rubella vaccine commonly known as “M-M-RII”.
