This is an automobile collision case. The plaintiff, appellant, is Leonard Rodgerson. The defendant, appellee, is Sherman La-Follette. The trial was to a jury. The facts are as follows:
On December 11, 1964, just before 7:30 a. m., the defendant was driving in an easterly direction on South Loop (also called U. S. 610) in Houston, Texas, when the motor of his car, for some unknown reason, stopped. He was able to get his car over to the right-hand curb, where he left it.
