PITTS, Chief Justice.

This suit was filed by appellant, Homer Brown, against appellee, Dallas Railway & Terminal Company, to recover damages for personal injuries sustained by his wife, Nellie Brown, about 7:30 o’clock a. m. on November 5, 1947, at a street intersection in Dallas, as a result of her body coming in contact with a moving bus owned and operated by appellee. The case was tried to a jury on special issues and as a result of the verdict judgment was rendered for ap-pellee, from which appellant perfected his appeal to the Court of Civil Appeals of the Fifth Supreme Judicial District…
