Plaintiff’s decedent was a drayman in Charlotte. On January 15, 1923, he was driving a Ford truck north on the Verona highway toward Battle Creek. When he reached the Grand Trunk Western Railway the crossing was blocked by a freight train which was moving slowly in an easterly direction on the south track. A short distance west of the intersection the caboose was cut off from the train and stopped on the highway crossing, partially blocking travel.
