WALLER, Justice:

We granted certiorari to review the Court of Appeal’s opinion Spahn v. Town of Port Royal, 326 S.C. 632, 486 S.E.2d 507 (1997). We affirm as modified.

FACTS/ISSUE

This is a comparative negligence case arising out of an accident in which the petitioner, John David Spahn, was injured when an automobile driven by John H.
