The subject matter of this case is litigation between the Price family, owners of land, and two corporate defendants who were alleged to have trespassed upon and created a continuing nuisance thereto. Two separate suits were brought and dismissed by W. P. Price, one of the tenants in common. See Price v. Empire Land Co., 218 Ga. 80 (126 SE2d 626). In 1967, W. P. Price then joined with the other owners in suing the same defendants, Empire Land Company and Central of Georgia Railway Company, in Chatham Superior Court, praying for a permanent injunction and damages…
