ORDER
DOMINGUEZ, District Judge.
This action was brought by Plaintiff under the provisions of Bivens v. Six Unknown Named Agents in the Federal Bureau of Narcotics, 403 U.S. 388, 91 S.Ct. 1999, 29 L.Ed.2d 619 (1971). The basis for the action is Plaintiffs claim that his Fifth and Eight Amendment Constitutional rights were violated while an inmate at the Metropolitan Detention Center (“MDC”). Plaintiff contends that he was assaulted by three of the defendants and that a fourth defendant knew of previous assaults and failed to take any corrective action.
