The Citizens’ State Bank of Tulsa, Oklahoma, organized under the banking laws of the state of Oklahoma, opened for business on the 2nd day of January, 1918, in said city. It was incorporated with a capital stock of $125,000, the par value of each share of stock being $100. The plaintiff in error, W. A. Reeves, who wall be referred to 'herein as the defendant, along with his father, entered into negotiation with the organizers of said hank, the latter part of December, 19.17, with the view of acquiring 35 shares of the capital stock of said hank.
