OPINION AND ORDER DISMISSING THE COMPLAINT
ACOSTA, District Judge.
Plaintiff, JORGE HERNANDEZ BAR-RETO (“HERNANDEZ”), his wife and their conjugal partnership instituted these proceedings alleging that HERNANDEZ was dismissed from employment by the defendant because of his military status in violation of the Uniformed Services Employment and Reemployment Rights Act of 1994, 38 U.S.C. §§ 4311 et seq. (“USERRA”), and its state-law counterpart, Act No. 62 of June 23, 1969, as amended, P.R. Laws Ann. tit. 25, §§ 2001-2098 (19...) (“Act 62”).
