The appeal is from an order denying appellant’s motion for a new trial after a verdict for respondent.

Plaintiff, administrator of the estate of his son Marvin J. A. Miller, brought this action to recover upon a $5,000 life insurance policy issued ^to Marvin, conditioned to pay said sum to his wife, Florence V., upon proof of his death. The company which issued the policy answered admitting its liability, asked leave to pay the amount into court and have the representative of Florence Y. made a party defendant, and the company dismissed out of court.
