MEMORANDUM

TROUTMAN, District Judge.

On June 22,1979, defendants were arrested pursuant to a sealed indictment, Count One of which charged each defendant with conspiracy to possess with intent to distribute and to distribute Phencyclidine (PCP), a Schedule III non-narcotic controlled substance, in violation of 21 U.S.C. §§ 841(a)(1) and 846. The indictment further charged that the plan and purpose of the conspiracy —acquisition, possession with intent to distribute, distribution and sale for profit of PCP — began in June 1973 and continued until August 1977.
