Plaintiff brought an action against defendant for support and maintenance under Civil Code section 206. That section provides that it is the duty of “the children of any poor person who is unabl e to maintain himself by work, to maintain such person to the extent of their ability.” The court without a jury determined that plaintiff is the father of defendant, that plaintiff is a poor person, that he is old and infirm; finally it determined that defendant was financially unable to contribute to plaintiff’s support. Plaintiff challenges the latter finding. It is the only issue argued on appeal.…
