This matter is before the Court on the April 30, 2009 recommendation by Magistrate Judge Kathleen M. Tafoya (Doc. # 83) that the defendants’ motions to dismiss (Docs. #30, 40, 75) be granted, that Plaintiffs Emergency Motion for Preliminary Injunction and Other Injunctive and/or Declaratory Relief (Doc. # 9) be denied, and that Plaintiffs case be dismissed.
