The question presented by this appeal is whether the Bank of America National Trust & Savings Association, a national banking association, and Jose Figueroa and Edward G. Brittingham, to. whom the defendant California Savings & Commercial Bank is admittedly indebted in the sum of $27,674.44, are general depositors and creditors of defendant bank or are entitled to receive payment in full as preferred creditors, or special depositors, from the cash in its vaults on July 23, 1930, when it was taken over as an insolvent institution by Will C.
