This case is brought here on appeal from a judgment of the court of appeals affirming a judgment of the district court of Arapahoe county; opinion reported in 8 Colo. Ct. App. 463.

The facts are there concisely stated as follows:

“ For some years prior to 1891, A. B. and F. W. Jefferay did business as a firm both in Kansas and in Colorado. While in Kansas their business was of a banting character, but in Colorado, to which they removed prior to 1891, they were carrying on business as merchants and dealers in furnishing goods.
