MEMORANDUM OPINION AND ORDER
NESBITT, District Judge.
This case is before the court on cross-motions for summary judgment filed by the Plaintiffs, the Trustees of the Laborers’ Health and Welfare Trust Fund of South Florida (“Trustees”), and by Defendant Frank Wilson, Jr. The case had been set for non-jury trial but was removed from the trial calendar when the cross-motions were filed. On May 26, 1988, this court entered an Order stating that the case would be heard on the cross-motions and any supplemental memoranda duly filed and consistent with the dictates of Fed.R.
