Brannon, Judge:
This was an action of trespass on the case in the Circuit Court of Cabell county by Lncetta Spicer, administratrix *515of Nicholas Spicer, against tlie Chesapeake & Ohio Railway Company, to recover damages for the death of her son Nicholas Spicer. The trial of the case resulted in a verdict and j udgment for the defendant, and said administratrix brings this writ of error.
The first point complained of in this Court is that the court refused the plaintiff’s instructions Nos. 2 and 3.
