Appellant Kelly Knott was convicted by a jury of robbery, evading arrest, and escape while under arrest. After pleading true to the alleged enhancements, Knott was sentenced to prison terms of 80, 20, and 35 years respectively, with the sentences to run concurrently. Appellant contends on appeal that the trial court erred in denying his motion to suppress the victim’s identification testimony, the trial court erred in refusing to instruct the jury on the lesser-included offenses of assault and theft, and the trial court committed fundamental error…
