Appellant Harold E. Sutton was tried before a jury on May 7, 1980, on three charges: aggravated robbery in violation of Ark. Stat. Ann. § 41-2102 (Supp. 1979); criminal attempt to commit capital murder in violation of Ark. Stat. Ann. § 41-701 (Repl. 1977); and theft of property in violation of Ark. Stat. Ann. § 41-2203 (Repl. 1977). The charges arose in connection with the theft of a truck belonging to Steven Benson and shots being fired at Benson during the incident. Appellant was convicted of the aggravated robbery and theft of property charges.
