This action was instituted in the district court of McIntosh county by the defendant in error, as plaintiff, against the plaintiff in error, as defendant, to quiet the title to certain land in said county. The plaintiff alleged in his petition that he was the owner of said land and in possession thereof. The defendant filed an answer and cross-petition in which he denied the allegations of said petition and pleaded title in himself.
