This suit was brought against the administratrix of the estate of Roy K. Wood, deceased, under the authority conferred'by § 171 of Pope’s Digest which reads as follows: “When any testator or intestate shall have entered into any contract for the conveyance of lands and tenements which was not executed and performed during his life, and shall not have given power by will to carry the same into execution, the party wishing a specific performance of such contract may file his petition against the executor or administrator in the office of the clerk of the chancery court of the county in which…
