Defendants, Demetrius Nickens and Fresh Start Solutions, Inc., are bankruptcy petition preparers. They have filed a motion to dismiss the pending adversary complaint in which Plaintiff, Tracy Lucas, the Debtor, seeks damages against Defendants for their alleged negligence and unauthorized practice of law and an injunction preventing Defendants from collecting their pre-petition claims against her and from filing future bankruptcy petitions in this court pursuant to 11 U.S.C. § 110.
