*688In a proceeding pursuant to CPLR article 78 to review a determination of the Zoning Board of Appeals of the Town of Southold dated June 7, 2001, which, after a hearing, annulled the Town Building Inspector’s decision to grant the petitioner a building permit, the Zoning Board of Appeals of the Town of Southold appeals from a judgment of the Supreme Court, Suffolk County (Jones, J.), dated July 1, 2002, which granted the petition, annulled the determination, and reinstated the building permit.
