Jackson, Justice.
This suit was brought by the guardian of the children of Mrs. Elizabeth Tufts on a policy on her life for three thousand dollars taken by her for their benefit. The policy contained the stipulation that the premiums were to be paid quarterly on the 3rd of August, November, February and May of each year; and in the event of failure so to pay, then the policy to be null and void.
