This is an action of ejectment to recover the possession of 20 acres of land situate within the corporate limits of Virginia City, in Storey county, Nev., described by metes and bounds, and alleged in the complaint to be known and. designated as the “Tailings Placer Mining Claim.” The parties having waived a jury trial, the case was tried before the court.
