This appeal considers the validity of Social Security Ruling (“SSR”) 82-31 which requires Veterans Administration (‘VA”) benefits paid to a veteran for the support of the veteran’s dependant to be counted as the dependant’s unearned income in calculating the dependant’s Supplemental Security Income (“SSI”) benefits. The Secretary of Health and Human Services (“Secretary”) appeals from a judgment of the United States District Court for the District of Vermont (Albert W. Coffrin, Judge), holding that SSR 82-31 invalidly interprets 42 U.S.C. § 1382a(a)(2)(B). We reverse the…
