The defendant NYNEX Corporation (“NYNEX”) moves this Court under Rule 12(b)(6) of the Federal Rules of Civil Procedure for an order dismissing plaintiffs first amended complaint (the “Amended Complaint”). Defendant urges that the Amended Complaint fails to allege the requisite elements of the claims asserted under Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e et seq.), Section 1981 of the Civil Rights Act of 1866 (42 U.S.C. § 1981), the New York State Human Rights Law (N.Y.
