Erickson’s Flooring and Supply Company, Inc., (“Erickson’s”) appeals the district court’s grant of summary judgment on its three claims against Tembec, Inc. and Tembec, USA, L.L.C. (together “Tembec”), its one claim against Kevin Gurican, and its three claims against both Tembec and Gurican. Erickson’s also appeals the sua sponte decision of the district court to grant summary judgment on the latter three claims against Gurican.
