This is the second appeal by the same parties of this action to recover unpaid commissions allegedly earned by plaintiff New England Technical Sales Corp. (“NETS”) as the exclusive New England sales representative of defendant SEEQ Technology, Incorporated (“SEEQ”).

NETS is a New Hampshire corporation; SEEQ is a California corporation. Both, however, have a usual place of business in Burlington, Massachusetts. The legal controversy between the parties, and both appeals to this Division, have centered on the enforceability of a “forum selection clause” in the parties’ sales distribution…
