Judgment of the Supreme Court, New York County (Blyn, J.), rendered February 6, 1980, convicting defendant, after a jury trial, of criminal possession of a weapon in the second degree, and sentencing him as a second violent felony offender to an indeterminate term of 4 to 8 years, is modified, on the law and facts, to reduce the conviction to criminal possession of a weapon in the third degree, vacate the sentence imposed, and remand to the Supreme Court, New York County, for resentencing, and otherwise affirmed.
