Defendant was convicted after jury trial of four offenses, consolidated for trial, of “assault and battery while unarmed by means of force likely to produce great bodily injury.” OBS 163.255.① The four offenses arose from one incident where four girls were pushed into the Columbia River by the defendant. Defendant was sentenced to three concurrent five-year terms and one consecutive term of five years. Since this comes to us on a demurrer to the indictments we do not have before us whether the facts developed at the trial warranted submission of the four cases to the jury. That the…
