The New York, Chicago & St. Louis Railroad Company began its action in the court of insolvency of Cuyahoga county to condemn for railroad purposes certain property belonging to Snyder and others. In accordance with Section 11046, General Code, the court first proceeded to determine certain jurisdictional questions relating to the existence of the corporation, its right to make the appropriation, its inability to agree with the owner, and the necessity for the appropriation.
