We listened to the defence in this ease, with great reluctance, and with serious doubts, whether without hearing the evidence, or the arguments of counsel, it was not our plain duty to reject and overrule it. This course, however, judges, who are conscious of their own liability to error, and aware of the hazard of trusting to first impressions, will rarely deem it expedient to follow, yet, in the present case, it might have been safely followed: our first impressions, so far from having been weakened, have been strengthened and confirmed by subsequent reflection.
