Gardner, Judge:

Plaintiff Betty M. Jones (the plaintiff) brought this action for malicious prosecution against Ingles Supermarkets, Inc., (the defendant). Following a jury verdict in favor of the plaintiff for $150 actual damages, the trial judge granted the plaintiffs motion for a new trial nisi; he ordered a new trial on damages, unless the defendant agreed to an additur of $7,500 in actual damages. We affirm.
