SMITH, Special J.
This is an action against the State of Oklahoma to recover damages for injuries sustained by a commissioned officer of the Oklahoma National Guard. The action is authorized by House Bill No. 283, enacted by the Fifteenth Legislature, and approved by the Governor on the 3rd day of April, 1935. The trial court sustained the demurrer to the plaintiff’s petition, and the plaintiff, electing to stand upon his petition, brought this appeal.
