BARNES, Justice:

This action was instituted in the District Court of Oklahoma County by Patrick and Flora Cramer (Plaintiffs) against Petitioner, State of Oklahoma, ex rel. John Coffey, Jr., Adjutant General of the Oklahoma Army National Guard, allegedly conferred by Senate Joint Resolution No. 34, duly approved by the Governor, which purported to waive the immunity of the State from suit.
