State v. Cockrell

Court of Appeals of Wisconsin

Decided September 30, 2007No. 2005AP2672-CRPublishedCited by 11 opinions

1Opinion of the CourtVergeront, J.

¶ 1. Caltone K. Cockrell appeals the judgment of conviction and sentence for attempted second-degree intentional homicide, first-degree recklessly endangering safety, and endangering safety by use of a firearm. He contends the prosecutor imper-missibly cross-examined him and commented in closing argument on his post -Miranda silence, and the jury instruction did not adequately explain to the jury the limited permissible purpose of the cross-examination comment on his silence. He also contends the prosecutor's comment in closing argument on his wife's non-appearance at trial was improper.
