This is an appeal from an order denying an alternative motion for judgment or a new trial.

On November 3, 1943, at the intersection of two country roads about four miles northeast of Wells, an automobile owned and driven by plaintiff and a truck owned by defendant Hockenhull and driven by defendant Johnson collided with each other, resulting in serious and permanent injuries to both drivers.
