On August 24, 2005, Magistrate Judge Michael H. Dolinger, to whom this case was referred for supervision of pretrial proceedings, issued a Report and Recommendation (the “Report”) recommending that the Court grant a motion by plaintiff Specialty Minerals, Inc. (“SMI”) to strike the unclean hands affirmative defense asserted by defendants Pluess-Staufer AG, Pluess-Staufer Industries, Inc., and Omya, Inc.
